All clients using the A1 Holidays.com.au website and all products and materials
associated with the website are bound to the terms and conditions in this document.
We assume that all clients of the website have read in full, understood and
agree to the terms and conditions of this website.

travel suppliers in an effort to provide the best available service to the client.
These suppliers may have different terms and conditions to A1 Holidays and A1 Holidays.com.au
and we must assume that you have read and understood the terms for these providers
upon booking. These secondary terms and conditions are available to view on
the bottom of each Hotel, Provider, and Partner web page/s within the website.

A1 Holidays takes all care but no responsibility for the information listed on
the A1 Holidays website. The A1 Holidays website is upgraded regularly, but second
and third parties supply all information. The reliability of this information
is taken in good faith and there is no guarantee to its accuracy. A1 Holidays reserves
the right to update, delete or change any information on this website without
prior notice. A1 Holidays makes no guarantee that this service will not be interrupted
or off-line, that the website or the contents of the website or other services
from this website are free from viruses or other harmful properties and accepts
no responsibility or liability for any costs incurred through the use of this

and all other countries applicable to the hosting of this website. A1 Holidays
herewith gives no permissions apart from those given in written form to any
person to reproduce, copy, distribute or use for any purpose other than the

Booking Terms and Conditions.
• The terms and conditions are applicable to all reservations made through
the A1 Holidays website or any link to another website in relation to a reservation
made through A1 Holiday Promotions Pty. Ltd trading as A1 Holidays, www.a1holidays.com.au and www.a1holidays.com.au. The registered offices of A1 Holidays are Unit 4 / 958

• You agree by using this website or other websites listed in the terms
of this agreement, that [1] you and the members of the party you are travelling
with, accept the booking terms of A1 Holidays. [2] That the terms and conditions
are final and no other arrangement will be entered into. [3] You agree to accept
the terms and conditions of the Hotel, Provider, Partner, or service you are
booking or making a reservation, which are clearly stated in the Hotel or Provider
or Partner terms and conditions on each Hotel or Provider or Partner pages within
the A1 Holidays website.
• When you make a reservation on the A1 Holidays website you have agreed
to purchase that product and that, you are bound by the terms and conditions
of the A1 Holidays website. You agree that no arrangement has been entered into
between A1 Holidays and you as a client until, [1] Receipt of payment of the agents
commission to A1 Holidays has been sent and confirmed by the payment gateway processor
“eWay” [2] You have received booking confirmation, [3] Your payment
for the required booking deposit has been accepted by the Hotel or Provider
or Partner you are making that reservation with.
Pricing.
• All prices are shown in Australian Dollars “Au or au” and
all payments made by you to A1 Holidays will be calculated in Australian Dollars.
Cancellation of booking.
• Cancellations of reservations more than fourteen days prior to arrival,
through the A1 Holidays website will incur a penalty fee of 10% of the total booking
cost with a further administration fee described in the terms and conditions
of the Hotel or Provider or Partner web pages for the building or property you
have made a booking. All cancellation of bookings must be directly with the
Hotel or Provider or Partner. Contact details for the Hotel or Provider or Partner
can be accessed from the booking confirmation form sent to you by email at the
time of booking. A1 Holidays will enter into no other arrangement.
• Cancellations of reservations less than fourteen days prior to arrival,

or Provider or Partner web pages where the booking has been made. All cancellation

enter into no other arrangement.
Amendments to booking.
• All amendments of bookings must be made directly with the Hotel, Provider,
and Partner. Contact details for the property can be accessed from the booking
confirmation form sent to you by email at the time of booking. A1 Holidays will
enter into no other arrangement.
General Provisions
• A1 Holidays will use its best endeavours to develop and update the Hotel
Reservation Site, Hotel listings, information regarding a Hotel or Provider
or Partner, developmental programs, maintenance of the hotel reservation system,
the advertising, site content and all text and graphics that relate to or appear
on the Hotel Reservation Site. The Hotel or Provider or Partner will be fully
responsible to maintain and list Hotel inventory at its discretion and to list
Hotel nightly prices or rates on the Hotel Reservation Site which A1 Holidays accepts
no responsibility or liability. Any conflict with a confirmed reservation or
booking due to the booking process that is found to be an issue with the Hotel
or Provider or Partner, you the client and the Hotel or Provider or Partner
will be responsible to resolve that issue. A1 Holidays will enter into no other
arrangement.
• A1 Holidays will use its best endeavours to ensure and upkeep-:
• The technical operation of the Hotel Reservation Site and all related
equipment;
• The accuracy and appropriateness of communication with customers; and
• The materials posted on the Hotel Reservation Site are not defamatory,
libellous or otherwise in contravention of any law.
• A1 Holidays makes no representation or warranty or undertaking that the
operation of the Hotel Reservation Site are and will be uninterrupted or error
free and A1 Holidays will not be liable or held liable for any loss or damage or
whatever consequences of any interruptions or errors.
• The client or customer accepts and agrees that the duties and obligations
of A1 Holidays under this Agreement are limited to issues relating to the online
hotel reservation process and confirmation but not further or otherwise and
the Hotel or Provider or Partner may refer any queries from any customer regarding
the online hotel reservation process and confirmation to A1 Holidays.
• Without prejudice, you the client or customer indemnifies and agrees
to keep fully indemnified A1 Holidays in respect of any claim demand or action
by you the customer or any person or entity against A1 Holidays for which A1 Holidays
is or will be or may be liable or held liable in connection with any loss damage
death injury cost or expense whatsoever, whether arising from contract tort
public liability or otherwise, sustained incurred or suffered as a result of
or attributable to any act omission negligence default or breach or other conduct
of the Hotel or Provider or Partner or by you or any other person or entity
whether under this Agreement or in relation to the Hotel Reservation Site or
any Hotel or any Hotel reservation or otherwise including but not limited to
any legal costs and expenses as between Solicitor and Client incurred by A1 Holidays
or for which A1 Holidays is or will be or may be liable or held liable.
• Other than issues relating to the online Hotel reservation process
and confirmation by customers A1 Holidays will forthwith upon receipt of any claims
or queries from any customer, whether or not directly or indirectly related
to Hotel or Provider or Partner or the Hotel or any room reserved or any other
issues, refer the same to Hotel or Provider or Partner for its attention and
handling.
• Save and except those stated A1 Holidays will not be liable or held liable
for any loss damage death injury cost or expense whatsoever, whether arising
from contract, tort, public liability or otherwise, sustained suffered or incurred
by any customer or Hotel or Provider or Partner or any other person or entity
in connection with or attributable to this Agreement or the Hotel Reservation
Site or any Hotel or any Hotel reservation or otherwise. Such aforesaid loss
damage death injury cost or expense will include but not limited to loss damage
death injury cost or expense caused by or resulting from any act or omission
or other conduct of A1 Holidays (except for gross negligence or wilful default)
or caused by or resulting from any act or omission or negligence or default
or other conduct of Hotel or Provider or Partner or any customer or any other
person or entity or owing to circumstances beyond the control of A1 Holidays, whether
consequential or otherwise and whether or not such loss damage death injury
cost or expense is reasonably foreseeable.
Customer Complaints.
• Complaints from a customer of the A1 Holidays website must be addressed
or notified in writing to A1 Holidays in letterform or by email as soon as possible.

• A1 Holidays takes all care in the website detail but is only a booking
agent and does not operate, manage or have a direct ownership with the Hotels
or Providers or Partners who advertise on the A1 Holidays website. A1 Holidays accepts
no responsibility or liability for any defects in the content including available
inventory that listed by the Hotel or Provider or Partner.
• Any applicable refunds for bookings and reservations due to cancellations
must be addressed to the Hotel or Provider or Partner and are limited to the
terms and conditions on cancellations on the Hotel or Provider or Partner pages
for that Hotel or Provider or Partner. All Hotel or Provider or Partner terms
and conditions vary and we assume that you have read and understood these terms
and conditions prior to making a reservation with the Hotel or Provider or Partner.
A1 Holidays will enter into no other arrangement.
• A1 Holidays reserves the right to change these terms and conditions without
notice.
• All bookings and reservations are governed by Queensland Law and are
subject to the jurisdiction of Queensland courts. These terms and conditions
are an agreement between you and A1 Holidays.
